By accessing, viewing, or using our Website, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy (“Privacy Policy”), available at https://carbsfuel.com/policies/privacy-policy, and incorporated herein by reference. If you do not agree to these Terms of Use or the Privacy Policy, please do not use our Website. By using our Website, you represent and warrant that you (i) are at least 18 years of age; and (ii) have the capacity to form a binding contract with us in your jurisdiction of residence. If you do not meet the foregoing requirements, you must not access or use our Website.

We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them on our Website. Your continued use of our Website following the posting of revised Terms of Use means that you accept and agree to the changes. Please check these Terms of Use frequently so that you are aware of any changes, as they are binding on you.

We reserve the right to withdraw or amend each Website, and any service or material we provide on the Website, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of any Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of a Website, or an entire Website, to all or certain users.

Use and Security

You need not register your email or fill out any of the forms available on our Website to review these Terms of Use or the Privacy Policy, or to access our Website. You may provide us with your name and email address to receive our updates via our newsletter. By registering your email on our Website, you agree that we may send you emails about Carbs Fuel, our subsidiaries and affiliates, and any products and services we provide. Further, you agree to notify us of any changes to your e-mail address. 

Our Privacy Policy governs all information you provide when you access and use our Website.

If, after registering your email with us, you decide you no longer wish to receive emails from Carbs Fuel, you may contact us at help@carbsfuel.com and we will remove your email from our distribution list. Your information will be treated in accordance with our Privacy Policy.

Your Account Details

Access to and use of certain functionalities and features of the Website may require you to register for a user account (“Account”) with us. If you decide to register an Account with us, you will provide us with certain information to create and access your Account. You agree to provide us with accurate, complete and current information about yourself during Account registration and at all other times, and you agree to update all information provided to us or requested by us if, and as soon as, such information changes and before you make any product purchase. You agree to keep your log-in information confidential and to not authorize any third party to use your Account. You agree that you will not solicit, collect or use the login credentials of other individuals. We prohibit the creation of, and you agree that you will not create, an Account for anyone other than yourself. We will not be liable for any loss or damage that results from the unauthorized use of your Account, either with or without your knowledge. You are fully responsible for your failure to safeguard information or for permitting any other person to access or use your Account, and you agree that we may attribute all use of your Account to you. You agree to notify us immediately at help@carbsfuel.com if you suspect any unauthorized use of your Account or any other breach of security. You may not sell or otherwise transfer your Account. We have the right to cancel or suspend your registration for any reason or for no reason at any time, as determined in our sole discretion.

Product Purchases

These Terms of Use apply to the purchase and sale of products through the Website and are subject to change by Carbs Fuel without prior written notice at any time, in our sole discretion. By placing an order through the Website, you confirm that you have read, understood, and agree to the Terms of Use in their entirety and agree to be bound by them. If you do not agree to the Terms of Use, please do not order any product through the Website.

General Requirements

By placing an order, you represent and warrant that:

  • You are at least 18 years of age (19 in Alabama and Nebraska; 21 in Mississippi).
  • If you are an individual consumer, the product is being ordered solely for your personal use, and you will not market, resell or otherwise distribute the product to any third party for commercial purposes.
  • If you are a business, please reference your wholesale and/or retailer agreement for concerns related to product purchases.

Product Descriptions

We use our reasonable endeavors to make sure that every product available for purchase on the Website is shown accurately and that prices are correct. However, product descriptions, specifications, features and images are subject to change at any time without notice. Without limiting any of the below, we do not warrant, represent, undertake or covenant in any way that any product description or related information will be accurate, complete, reliable, current or error-free, and we are not responsible for errors (typographical or otherwise) in any of the foregoing.

Order Acceptance and Cancellation

Under these Terms of Use, you agree that your order is an offer to buy all products listed in your order. All orders must be accepted by us, or we will not be obligated to sell the products to you. We may choose not to accept any orders in our sole discretion. When you place an order (by choosing your product and completing the online checkout process), we will send you an order acknowledgement by email. This will detail the products you have ordered. Please note that your completion of the online checkout process does not constitute our acceptance of your order. Our acceptance of your order only takes place when we ship it. A contract of sale between you and Carbs Fuel is therefore made at the point of shipment, rather than at the point of payment. If you have cancelled your order, or if we notify you that we cannot accept your order, then no contract of sale will have been made. From time to time, we may not be able to accept an order, including for the following reasons: (i) where we cannot obtain authorization for your payment; or (ii) if you do not meet any eligibility criteria set out in the “General Requirements” section of these Terms of Use. We reserve the right to cancel your order at any time and issue a full refund. We reserve the right, but are not obligated, to limit the sales of products to any person, geographic region or jurisdiction.

Prices and Payment Terms

All prices posted on the Website are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or charges for shipping and handling. All such taxes and charges will be added to your merchandise total and will be itemized in your shopping cart and in your order confirmation email. We are not responsible for pricing, typographical, or other errors in any offer by us and we reserve the right to cancel any orders arising from such errors.

Terms of payment are within our sole discretion and payment must be received by us before our acceptance of an order. We accept major credit or debit cards and PayPal for all purchases. You represent and warrant that (i) the credit card information you supply to us is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including all applicable taxes, if any.

Shipments; Delivery; Title and Risk of Loss

We will arrange for shipment of the products to you. Please check the individual product page for specific delivery options. You will pay all shipping and handling charges specified during the ordering process. Orders containing multiple items may be shipped separately.

Title and risk of loss pass to you upon delivery at the provided address during checkout. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments. If any of the details you have given us in your delivery address are incorrect, we are not liable for any items which are not received.

Circumstances Beyond Our Control

Neither we, nor any courier or carrier service that we use, shall be liable for any failure to perform under these Terms of Use, where such failure or delay results from any circumstances outside our reasonable control.  These circumstances include but are not limited to, adverse weather conditions, such as snow, flood, extreme winds, fire, explosion, accident, traffic congestion, obstruction of any private or public highway, acts of governmental authorities, pandemic, riot, terrorism, act of God, or from any industrial dispute or strike.

Returns and Refunds

Please see our refund policy at https://carbsfuel.com/policies/refund-policy. If your order was damaged in transit, or if you've received the wrong order, please reach out to our Customer Care team immediately, by emailing help@carbsfuel.com.
 
If you believe there is a quality issue with your product, please take note of the product lot number (a series of numbers with a timecode that is printed near the expiration date), so that we can trace the specific batch of product you have received. These inquiries will be handled on a case-by-case basis.

Linking to our Website

You may link to the homepage of our Website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part without our express consent. Subject to the foregoing, you must not:

  • Establish a link from any website that is not owned by you.
  • Cause our Website, in whole or in part, to be displayed on, or appear to be displayed by, any other site, for example, framing, deep linking, or in-line linking.

All rights, title and interest in and to each Website and all of the contents (including without limitation all information, software, images, video, and audio), features, functionality, and format on each Website (collectively, “Website Content”) are owned by Carbs Fuel or its licensors and are protected by intellectual property laws and other proprietary rights laws, including trademark, patent, trade secret, and copyright laws. All names, logos, product and service names, designs, and slogans that may appear on any Website are trademarks of Carbs Fuel or our licensors. You may not use such trademarks without our prior written consent.

You may, subject to the restrictions of these Terms of Use, utilize our Website and the Website Content and features solely for your own personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Website Content, except as follows:

  • You may store files that are automatically cached by your web browser for display enhancement purposes.
  • You may print or download one copy of a reasonable number of pages of any Website for your own, personal, non-commercial use and not for further reproduction, publication, or distribution; provided that you must not delete or alter any copyright, trademark, or other proprietary rights notices contained on such printouts.

You may use our Website only for lawful purposes and in accordance with these Terms of Use. You agree not to use our Website for the following purposes:

Carbs Fuel is based in the State of Colorado in the United States. We provide this Website for use only by persons located in the United States. We make no claims that the Website or any of its content is accessible or appropriate outside of the United States. Access to the Website may not be legal by certain persons or in certain countries. If you access the Website from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

The information presented on or through our Website is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of any Website Content, including any specifications or other information about our products or services. Any reliance you place on such information is strictly at your own risk. No information, whether oral or written, shall create any warranty, representation, or guarantee not expressly stated in this section. You agree not to object to the exercise of personal jurisdiction by or to venue in such courts.

Any claim must be commenced within one year after the date the party asserting the claim first knows or should know of the act, omission, or default giving rise to the claim, or the shortest time period permitted by applicable law.

We reserve the right to investigate any possible violations of these Terms of Use. We may suspend or terminate your use of our Website and the licenses granted herein authorizing your use of our Website, including Website Content, at any time for any or no reason, including, but not limited to, if we reasonably believe you have violated our Terms of Use. You agree that all terminations shall be made in our sole discretion and that we shall not be liable to you or any third party for any termination of your use.
